CHINA INVESTMENT

Q: Sir other issue, there is a living scholar and former UN Ambassador from India that want ASEAN countries especially Philippines to be wary about the massive investment in China kasi daw we might end up paying more than what we bargained for. What can you say as chairman of the committee on Economic Affairs?

SEN. WIN: Actually the reminder, the warning is not necessary because our department of finance is really keeping tab of our debt levels, debt levels natin ngayon is hovering over 40% this really way below advance countries. The US and advance countries, doble ang GDPng debt levels nila, satin 40% of our GDP, so malayo pa tayo in some other countries. 200 or 300% and dito sa economic affairs committee we are constantly monitoring the debt levels of our country. In fact ang pinaka concern is not the debt level but yung quality of debt na pinapasukan natin. Madami kasi dito sa ODA's natin may tinatawag na tide loans, ibig sabihin pag umutang ka may supplier na, eh pano kung yung supplier hindi magaling o corrupt? So yun ang dapat bantayan, at natuklasan namin sa isang hearing naman sa Economic affairs na wala tayong mechanism to monitor tide loans. So what we are proposing in one of our legislative proposal is to monitor and tighten the rules for tide loans. Para kahit pautangin tayo or bigyan tayo ng grant, wala nang kaakibat na bulok na supplier dahil tayo rin magbabayad ng bulok na serbisyo na yun at the end of the day, tayo yung malalgay sa alanganin.

Q: So malayo pa tayo sa kagaya sa Sri Lanka? kasi yun po yung warning, we might end up like Sri Lanka Sir.

SEN. WIN: I think in terms of managing our debt and in terms of fiscal management in the Philippines we doing quite well. Makikita natin over the last ten year we've been upgraded many times to investment grade. In fact, there is a pending upgrade within the year. I think from the debt watcher's point of view, fiscally we've been managing our financial health quite well. So I think this is where the Senate and Congress will come in in terms of oversight. And we've been quite active in monitoring debt levels and potential ODA's that the country will enter into.

Q: Sir importante to make sure that viable yung mga projects ng mga investments?

SEN. WIN: Ang importante naman pag pumasok ang investments, pumasok, let's say na loan sa atin. Itong loan dapat magamit ng tama na hindi naman yung supplier ang nakaakibat sa loan, hindi yun maayos. We want to make sure hindi lang nagpapautang sa mga bagay na walang impact sa atin. Importante yung pinapautang sa atin or bibigay na grant ay napupunta sa high impact project. Let's give credit where credit is due, if you look at the Build, Build, Build program, dahil tinignan ko lang yung site the other day. Yung mga high impact projects for the first time mapopondahan na. tulad nung North Rail na kami sa Valenzuela makikinabangan talaga doon. Matagal na naming pangarap yan, after 15 years sa wakas matutuloy na. Yung subway, na Valenzuela rin ang makikinabang, from Valenzuela all the way to Makati yun. So makikinabang rin kami and these projects are high impact na kaagad mararamdaman ng tao.

Q: Kasi sir baka naman malubog tayo sa utang, baka hingiin nila yung West Philippine Sea?

SEN. WIN: importante yung legislative oversight sa mga ODA's and debt levels. In fact may mga legislation na pino-propose dito na maglagay ng debt cap. Ibig sabihin wag tayo uutang beyond our capacity. So may mga ganun na mechanism na pinaguusapan para di maabuso o masobrahan sa utang ng ating bansa.

ECONOMIC MANAGEMENT RATING

Q: economic policies and Energy... [inaudible]

SEN. WIN: well I'll divide that into two, first over-all management of our economy. I'll probably give the economic management 7 our of 10, 10 being the end result of this fiscal year. At the end of this year the question is, nagamit ba yung pera na ibinigay sa gobyerno? Malalaman lang niya yan sa full utilization at the end of the year. So they will be graded accordingly lalo na pag budget season dahil titignan yung utilization. But if titignan mo yung other utilizations like the GDP growth your hovering around 6.5, unemployment bumaba to 5 so ang ating poverty rates bumaba din at about the level of 22% So maganda naman yung manangement ng ekonomiya natin. So if you look at the surveys, ang taong bayan na fe-feel ang fruits ng ating economic growth. Although, marami pa dapat gawin. If you go to the countryside, mataas pa rin yung rural poverty levels natin. Yan pa yung mga challenges na hinaharap ng economic managers. Pagdating sa energy naman cause I chair the Energy Committee, madami pang tayong kailangan gawin to be more stable. Tamang-tama lang ang energy supply natin and demand at 13,000 Megawatts. In a perfect setting dapat mas madami tayong supply, hopefully 30-40% more so malaking challenges pa, one of the biggest challenges really is red tape and I've talked about this many times to apply permitting alone for power plant will take you 4 years. Maraming na tuturn-off at ayaw mag invest dahil matagal yung red tape sa atin.

ENERGY AND POWER RESOTRATION

Q: Sir as Chairman of Energy do you have any plan to ask for a briefing from DOE doon sa power restoration sa mga nasalanta?

SEN. WIN: Actually, I've been monitoring the situation in Leyte and on the ground may kausap rin tayo dun. I think over-all naman ang damages sa grid system natin ay minimal lang so the COOPS are doing their best to get the power up and running so If I'm not mistaken mga one or two weeks more.

Q: So wala kayong coconduct na hearing?

SEN. WIN: The DOE is on top of the situation and kami nakikipag coordinate so there's no need to conduct a formal hearing.

SEN. WIN: Ang ating challenge really is the additional supply, not really backlog but additional supply. If you look at the supply and demand, tamang-tama lang eh. But gusto mo may sobrang 30% no--

Q: paano if earthquake paano yung supplies?

SEN. WIN: Exactly, dahil Leyte is one of the biggest supplies of geothermal, that's why ang challenge ngayon ay mabawasan na ang red tape para mas dumami ang pumasok na supplies. For example may kausap akong Koreans, gusto nila magtayo ng planta dito pero nagkakamot sila ng ulo dahil yung red tape ang tagal. For them 4 years of red tape is really complicated for them dahil sa Korea 1 year or 1.5 years lang eh. Pag meron ka nang permit, pwede ka na magpatayo ng planta. These are the challenges that we really need to fix and the DOE needs to fix.

Q: Aside from the problems na nabanggit niyo sa energy sector, susceptibility sa calamaties, bagyo, ano kaya pwede natin magawa?

SEN. WIN: I think two things, nag file tayo ng bill, sa mga kalamidad ang unang-una bumabagsak ay kuryente dahil yung facilities nila bumabagsak. So two things, to make them resilient ibig sabihin kung for example sa Bicol area ka at alam mong madalas bumagyo doon, dapat gawin natin resilient ang mga cooperatives. Mas malaking poste, mas malalim na poste, so we have to give them the fund to be resilient. Number two, rehabilitate as quick as possible. In a very strong typhoon or major calamity it takes two weeks para ma rehabilitate so were setting up a calamity fund for the coop para ma-access nila kaagad at ma rehabilitate nila ang mga kooperatiba. Almost the entire Philippines is covered especially the remote areas covered by cooperatives.

Q: Revival of BNPP

SEN. WIN: Ako personally, I'm not in favor of putting up the reviving of the BNPP for two reasons; Number one, natutulog na yan for the last 40 years, na overtaken na yan ng events so there are newer and safer technology that we can use. Number two is national security, nakita natin ang nangyari sa Marawi and nakita natin ang unang prediction na in 5 days matatpos na ang gulo sa Marawi pero ngayon almost more than a month na. Just imagine if BNPP yung pasukan ng terorista. Yan talaga yung mga target ng terorista yung mga critical facilities, yung mga high-risk facitilies dahil itong mga to can cause maximum damage. considering the limitations of our military and our police force I think we should shy away from high-risk fuel sources such as nuclear. Sa ngayon, kulang pa tayo sa capability to protect those type of facilities.

BARTOLINA, DEATH PENALTY AND DRUGS

Q: Comment on pangulo Duterte encouraging the use of Bartolina in prison?

SEN. WIN: it makes sense na i-segregate or ilagay sila sa isang maximum security cell para ma minimize yung pag-contact sa labas. I think yung pagbenta ng drugs dahil may contact sila sa labas. May access sila sa cellphones and internet that enables them to trade drugs from within to the outside. Pangawala, babalik na naman tayo sa corrupt na officials sa loob no, nakita natin pinalitan ng SAF pero ilan rin sa mga SAF na corrupt din. We really have to look at the this angle also, bakit na co-corrupt itong mga official na nilalagay natin? To think that we were hoping that SAF was incorruptible but na- corrupt din yung iba sa kanila. We should also look at this angle and look at the compensation ng mga nagbabantay doon. Kasi kung kinikita nila is 18 to 20,000 a month tapos i-ooffer sila ng mga druglords ng 100,000 a month, talagang ma te-tempt sila. So we also have to look at the practical side of things which is the compensation of our police force and the BJMP personnel in New Bilibid Prison.

Q: Sir, when session resumes you think we should still push for death penalty?

SEN. WIN: Akin, yung position ko sa death penalty, large volume drug trading. Itong mga drug lords, convicted na itong mga to and even though you convict them they will find a way to trade drugs inside of our facilities, it's a very lucrative business. Estimate nga ng PDEA it's a 100 Billlion business a year conservatively, with that large amount of money going around alam nila yung weakness ng legal and administrative system. That's why it's easy to corrupt within the penal colony natin. Ako that's my position, you cut the source, the source is really the drug lords operating within the penal colony.

Q: Sir, diba recently may malaking bulk ng drugs sa Valenzuela na nahuli?

SEN. WIN: Actually yung nangyari sa Valenzuela naging transshipment point siya, dahil marami na nga ang nahuhuli na drug laboratories, which is good news, itong mga drugs pala ay iniimport na gamit ang mga machineries, tinago sa isang steel roll, niligay nila doon at pag dating sa Valenzuela doon naman dini-distribute sa iba. Good thing meron nagbigay ng intelligence information kaya nahuli but itong mga drug lords nagiging innovative also dahil nga nahuhuli na yung mga drug laboraties, ini-import naman. Ang question, paano nakakalusot sa ating customs borders? Again, alam nila yung weakness ng ating sistema so dapat na talaga putulin yung source ng drugs.

Q: May investigation na ba na ginawa si Senator Gordon?

SEN. WIN: I think nagkaroon ng briefing pero walang formal investigation. I think nagkaroon ng briefing ang Committee on Public Rrder and Drugs.

MARTIAL LAW EXTENSTION AND REHABILITATION

Q: on the briefing given to you by DILG and PNP officials recently ano yung mga highlights and natanong po ba yung possible Marital Law extension?

SEN. WIN: Actually, we all agree that meeting should be covered by the Executive session so I can only divulge few of the items there. Number one is the rehabilitation, I was quite focused on that dahil marami din akong kausap na kababayan natin sa Marawi. Yung mga local leaders and public servants and marami sa kababayan natin doon, dahil nakita nila nasira ang livelihood and mga bahay marami sa kanila ay nagagalit na sa gobyerno. I told the DILG, dahil participants nila ang Martial Law group, that they really have to jumpstart the rehabilitation process. 20 Billion is the initial fund that should be allocated but in my personal computation kulang ito. That's why ngayon sa pag pasok ng budget season, We really need to have the detailed report on how much to build back better Marawi. The other one really is the proposal to extend martial law. In that meeting wala pang proposal to extend Martial Law, it's still a very fluid situation that's why request noong mga Senators na andoon is to have a briefing prior to SONA form the Security cluster para malaman natin kung ano nangyayari sa ground. Q: Sir, na-mention sa briefing sa early stage ng rehabilitation dapat meron pa rin Martial Law dahil meron pang mga remnants ang mga terrorist groups?

SEN. WIN: I think the rebuilding will come when the city is completely cleared at pag wala nang Maute group inside the city. But I think ang pinaguuspaan ngayon, assuming na matapos na ang gulo sa Marawi and the Maute group is completely extinguished at kung meron pa bang threat from the other groups, kasi alam naman natin na hindi lang Maute group ang kalaban natin. May Abusayaf, may sympathizers, meron mga grupong papasok ulit at kakalat sa ibang lugar. Maybe in a smaller municipality or smaller town. Ito'y mga information na tinatanong namin para maging educated yung decisions natin.

Q: So meaning once mag-start na yung rehabilitation wala nang Martial Law?

SEN. WIN: Wala nang Maute sa Marawi, dapat cleared na but whether to extend Martial Law or not, that's subject to the briefing from the security cluster.

Q: naniwala ka ba sa sinabi ni Presidente na 10-15 days ma re-resolve na yung Marawi Crisis?

SEN. WIN: The President gets complete briefings everyday, I'm sure--

Q: May basis yan?

SEN. WIN: May basis yan I'm sure, he has more information and intelligence than all of us. So I think yung estimate may basis yun.

TAX REFORM BILL AND VAT EXEMPTIONS

Q: On the tax reform bill na napasa sa house, ano sa tingin niyo ang mga provisions na malabo makapasa sa Senate and dapat ifine-tune pa?

SEN. WIN: Isa sa mga nakita namin agad, or at least what I saw dahil I've been attending the Ways and Means Committee hearings-- hindi ako Vice Chairman, just a member but since taxes is part of the well-being of the economy, I made it a point to attend all the hearings para malaman namin lahat ng impacts sa economy. Siguro the first item that needs to be discussed is the sugar beverage sweeteners tax. If you recall, 10 pesos ito per liter, so litro ng coke or ng matamis na drink regardless kung maraming sugar ito or onti yung sugar na ito, papatong ng 10 pesos. In my opinion, it should be content based yung sugar tax, hindi naman lahat ng 1 Litro pare-pareho yung content ng sugar para naman may incentive ang mga manufacturers na babaan nila yung sugar ng kanilang drink. Dahil yung mga ibang sugar drink over time babaan nila yung content ng sugar. So yun yung isa, of course we will also review the excise tax, dahil may mga impact excise tax on vehicles and on oil. And we will also review the exemptions dahil kahapon nagkaroon ng hearing and all of the exemptions were discussed. One of the most glaring doon is yung batas natin on rare diseases. Kung meron kang rare disease, exempted ka magbayad ng VAT and yung mag do-donate sayo for your disease exempted din sa VAT and donor's tax. According sa hearing kahapon ang pinaka-murang gamot para sa may rare disease is 100,000 pesos. So kung may mga mahihirap natin na kababayan ay makakuha ng donation, mas maraming gusto mag donate dahil walang donor's tax hindi VAT-abble, mas makakatulong sa mahihirap natin. Pero kung papatungan mo na yan, syempre yung mga donor's mag dadalawang isip dahil nag bayad na nga siya ng donor's tax tapos magbabayad pa siya ng tax doon sa donation. So ito yung mga exemptions, dapat pag-aralan mabuti dahil meron silang objective, tignan natin baka naman ma-marginalize or meron tayong mga grupong madehado naman dahil tinanggal natin ang kanilang mga exemptions.

Q: Sir yung VAT-exempt doon sa mga rare disease at mag dodonate, tatanggalin?

SEN. WIN: Tatanggalin, ang gagawin nila, lahat ng tax exemptions tatanggalin.

Q: Pabor po ba sainyo yan sir?

SEN. WIN: kahapon, doon sa hearing baka ma-karma tayo dahil yung mga nangangailangan ng tulong yun pa yung tatax natin. So we really have to study carefully ang pagtanggal ng VAT exemptions.

Q: Sir, yung pagtanggal ng VAT exemptions sa socialized and local housing ano yung stand niyo diyan sir?

SEN. WIN: Ang laki ng housing backlog natin diyan. Almost 5 million ang housing backlog natin at nagkakaroon tayo ng backlog dahil marami tayong mga kababayan na hirap bumili ng pabahay. In fact, doon sa hearing lumabas na 40% ng mga nakatira sa informal setllers ay yung mga taong may regular na trabaho. So ibig saibihin kait may regular na trabaho, hirap ka pa rin bumili ng bahay. So again, if tatanggalin ang exemptions based on those sa hearing, taas yung presyo ng bahay by at least 30%. So mas mahihirapan ngayon mga kababayan natin bumili ng bahay. Again, we really have to study this kasi kung patataasin natin yung presyo ng pabahay mas rarami ang hindi makakabili ng bahay.

Q: objective ng tax reform bill is to simplify yung tax system, maging equitable and efficient, pero marami atang provisions doon na sinasabi na anti-poor?

SEN. WIN: not necessarily, admittedly, the last time we had a massive tax reform was years ago. So it's about time to really look at the tax laws and to have a simplified system dahil diyan talaga pumapasok yung tax evasion dahil magulo yung sistema natin. The objective here is to simplify it to harmonize all the tax laws. Makikita natin maraming harmonization dito, I appreciate that and tingin ko tama yun, again, tignan natin, the devil is in the detail. Tignan natin ang mga sector na tatamaan, yung mga sector na maagrabyado, baka naman sa pag-simplify natin magkaroon ng sector na makakawawa sa simplification. So we have to go through the details one by one. Q: suportado niyo po ba yung excise tax sa oil? Inflationary daw yan eh, samantalang doon sa tax relief wala nang benefit na matatanggap ang minimum wager dahil exempted na sila so makikinabang dito yung minimum?

SEN. WIN: I think the concept here, dahil nga yung mga kumikita 2000 and below will be exempted from tax so may additional take-home na siya. On top of that mabibigyan pa siya yung tinatawag natin na cash transfers para sa mga mahihirap na kababayan natin. Dahil nga tumaas ang excise tax mabibigyan sila ng mga programa na makakatulong sa mga araw-araw na gastusin. For example yung pangtawid pasada, may mga cash transfers, yung naman yung titignan namin yung mga cash transfers dahil we have to make sure itong excise tax na pagtaas na maapektuhan ay mabibigyan naman ng immediate relief through cash transfers. Yun naman talaga yung agreement from day one, yung mabigyan ng targeted relief itong mga sector na pwede tamaan ng pagtaas ng excise tax.

Q: [inaudible]

SEN. WIN: I can't say that with certainty, because in the normal course of decision the Chief Executives rely on their top officials for recommendations. Again no, this is an assumption. I'm assuming this came from the management and leadership of the PNP. SONA

Q: July 24, SONA ni Presidente Duterte ano nakikitang niyo accomplishments ng Duterte administration na pwede ipagmalaki ng pangulo at ano yung gusto niyong marinig sa kanya and plans for the futute?

SEN. WIN: I think top of mind ko two things, number one of course the ever favorite war against drugs. I think looking at the surveys, the public opinion and poll surveys more or less is hovering at 80% na nagpapakita na ang mga kababayan natin feels safe. I think this is quite a feat dahil even kami sa Valenzuela, I talk to sa mga kababyan natin doon sinasabi sakin 'Sir, talagang feel namin ngayon safe, nakakalakad na kami sa gabi at nakakuwi na from the call center ng madaling araw' this is actually an achievement. But to sustain this is another question we have to make sure meron tayong institutions to sustain this. Di lang ad-hoc na gusto ng ating pangulo 6 months gawin to, we have to make sure this is sustainable.

Number two, Build, Build, Build program again no Tiningnan ko ang website a few days ago, ang mga malalaking projects tulad ng subway, north rail, south rail, Mindanao rail, these are all our dreams before pero ngayon meron ng launching date. I think this is also quite an achievement. Of course, gusto ko pang makita is sustainability hopefully, hindi lang ito for SONA purposes but to sustain it for the next five years. How do you sustain it for the next five years? And the next administration should also benefit from that sustainability. To be honest, one of the weaknesses of our country is short-term mentality, even if you look at our PDP is always until the end of our President. Kung tapos na ang President natin, tapos na rin ang development plan natin. In other countries is as long as 20 years so we have look at our next generation as part of the beneficiary.

DISSOLUTION OF MARRIAGE

Q: Sir, pa-comment doon sa gusto ni Speaker Alvarez, yong tungkol sa dissolution ng marriage? SEN WIN: Ako, kaya ako happy dahil wala pa akong asawa eh. Joke lang yun ha. Joke lang yun. I haven't really read ang proposal or the bill. Ako ang position ko, if the relationship is already marred in violence, in drugs and in abuse there should be a mechanism for couples to separate. Kung talagang inaaabuso na ang one of the partners regardless kung sino, dapat maghiwalayan na dahil hindi naman tama na ang isang party ay agrabyado na ng sobra. Q: Hindi ba yon tantamount to divorce, ang dissolution to marriage?

SEN WIN: Alam niyo, maraming terminologies, you can come up with legal terminologies, at the end we have to look at the details of the law. Ako, hindi ako pabor sa Las Vegas style divorce na pwede kang magpakasal ngayon, bukas divorced ka na. That's the common understanding of the divorce dahil yan ang American model eh na pwede kang mag-divorce in a few minutes, I don't agree with that.

SENATE PERFOMANCE RATING

Q: Sir, anong assessment mo naman sa performance ng Senate? Doon sa first year?

SEN WIN: I saw the public opinion poll survey of SWS and Pulse Asia. I think Pulse Asia for that matter, the Senate garnered the highest approval rating in history and if I'm not mistaken, ang tingin ng tao ngayon ay maganda sa Senado and also for Congress. For the Senate, maganda ang impression ng tao, maganda ang perception ng tao, and I told the Senate President that we should continue and do more. At the end of the day, itong mga legislations should be meaningful sa ating mga constituents. Dapat nafi-feel ng tao, that's why we're required also to submit 3 priority bills that will impact our constituents immediately.

NATIONAL ID SYSTEM AND BARANGAY SK ELECTIONS

Q: How about National ID system?

SEN WIN: Ako, I'm in favor. In fact, I filed a bill to that effect, dapat matagal na tayong may National ID system for many reasons: 1.) convenience, dito lang sa atin meron kang GSIS, may driver's license ka, may passport, postal ID, voters ID, Philhealth, but if you look at the information it's all the same so why not unify it? 2.) to fight criminality; the criminals really go underground so if we can have a system that everyone is required to give their details, this will help our police force to detect criminals na nagtatago.

Q: Sir, what about on the cancellation again ng barangay and SK election?

SEN WIN: Nagkaroon na yan ng hearing dito, the original premise of the first postponement was to remove the 40% barangay captains who are supposedly involved in illegal drugs. Our question is ano nang nagyari doon sa 40%? Binigyan natin ang DILG ng 1 year para tanggalin itong 40%, ano nang nangyari? We want an update. I don't think pwede pang magamit yang reason na yan to postpone the barangay elections.

Q: Yung mga local officials, gusto nila bigyan ng ID ang mga Muslim?

SEN WIN: Hindi tama yun. That's plain and simple discrimination at hindi tama na i-require ang ating mga Muslim brothers and sisters ng ID, what we need is to engage like, going back to Valenzuela, ang Muslim community namin doon is about 2,000 and we engage them, opening lines of communication para kung meron silang mga nakikitang hindi tama, diretso sa amin ang information. Hindi tama na i-require silang magbigay ng information for ID, that's discrimination.

Q: Is this important sir na ma-approve agad ang National ID system?

SEN WIN: I think so, consensus yang ng marami na it's about time to have a National ID system at i-register na din ang mga prepaid sim card dahil sanhi din yan ng criminality dito sa ating bansa. If you look at the statistics, there are about 110 million active and outstanding prepaid sim cards in the whole country. Kung ang population natin ay 100 million, pati sanggol ay may prepaid sim card na rin eh. It just goes to say na doble-doble ang prepaid sim cards na lumalabas sa bansa natin kasi ang iba dalawa, ang iba tatlo, apat, and that's becoming a source of harassment and criminality. So it's about time to have that registration of prepaid sim cards. Sa Asia, tayo na lang ang wala, Singapore, Malaysia, and other countries meron na.

Q: How will you address ang concern na parang nai-invade daw ang privacy? May invasion of privacy daw itong National ID system?

SEN WIN: We will have safeguards para maprotektahan ang privacy ng ating mga kababayan, in fact, in the E-Commerce Law and the Cybercrime Law, there are safeguards to protect our identity and to protect us from identity theft kasi dapat masigurado rin natin ang information na malilikom sa National ID system, hindi maiikalat. Baka ikalat naman sa mga nagbebenta ng real estate so bawal naman ang ganun. We will have safeguards to make sure na protected ang identity natin.

SEATMATES
