Benham Rise and Barangay Elections

Howie: Senator Gatchalian kayo ang Chair ng Committee on Economic Affairs and Finance, bakit kayo nangunguna dito? What people see here in this is a security and defense issue?

Sen. Win: Actually ang hearing namin ay isang pagtatalaga ng Benham Rise Development Authority. Nagkaroon na kami ng first hearing three weeks ago, and itong hearing na ito ay isinagawa namin dahil since 2012 wala pang malaking exploration and research na nangyayari sa Benham Rise (BR). Ang Benham Rise is about 24 Million Hectares, mas malaki pa ito sa island ng Luzon na meron nakitang mga methane hydrates na pwede maging source of energy para sa ating bansa. Pero hindi natin makukuha ang source ng energy kung hindi tayo mag eexplore and research kaya si Senator Angarra ay nag- file ng isang bill para maitalaga ang Benham Rise Authority (BRA). Economic Development and direksyon ng Benham Rise Development Authority (BRDA).

Howie: Pumutok sa balita na may mga China, mga barko, sa loob ng Benham Rise na sinasabi ng DFA na walang pahintulot ng pamahalaan pero si Pangulong Duterte may ibang pananaw dito? What is your reading of Benham Rise in terms of Chinese vessels maybe exploring or travelling in the area?

Sen. Win: Actually one week after nagkaroon kami ng hearing sa BRA nagkaroon ng supposedly ng pagdaan ng Chinese vessels at ayon sa mga research at pag-aaral, itong Benham Rise ay isang ship passage lane. So di lang Chinese ang dumadaan diyan, innocent passage ang tawag dun which is allowed by law. What is not allowed is exploitation, kung sila mag dri-drill doon sa Benham Rise. Hindi yun pwede dahil tayo lang ang may exclusive sovereign rights over Benham Rise and even the extended continental shelf.

Howie: pero kayo mismo ano ang paniniwala niyo? Dumadaan lang ba ang China diyan or is it actually more than that, exploring or surveying? Nangunguna ba sila sa atin in terms of trying to find what's there or in terms of exploitation?

Sen. Win: Dalwang bagay, kaya kami nag desisyon na magkaroon ng hearing ay dahil sa sovereignty and defense angle. Ang gusto natin ay isama sa pagtatalaga sa BRA. Kaya inimbitahaan namin ang DFA para magbigay ng linaw at patatagin pa ang ating sovereign rights. Dapat klaro ito at dapat ma-capture ito ng BRA. Pangawala naman ay marami tayong mga explorations and research partnerships with different countries. In fact madami ang gusto makipag-partner satin para i-explore at painamin ang research diyan sa BR dahil nga sa nakitang methane hydrates that can be a possible source of energy for our country. So for research and exploration, pwede tayo makipag-partner with other countries not only China. In terms of exploitation and harnessing of fuel, tayo lang may exclusive rights para gawin yun.

Howie: In terms of innocent passage, di na kailagan ng permiso ng Pilipinas, pero yung surveying and exploration kailangan talaga ng pahintulot no--

Sen. Win: Yes, kailangan ng pahintulot yan--

Howie: Yes, humingi na ba ng pahintulot ang China sa ating pangulo para mag survey doon?

Sen. Win: Yan ang klaklaruhin natin pag dating ng hearing dahil dapat klaro ang protocol, dahil pag dating ng exploration and research kung ano man ang matutuklasan doon, dapat mapupunta satin and tayo ang gagamit. For example, kung ano man ang matuklasan natin in terms of biodiversity and food security, ay dapat tayo ang makagamit para sa kinabukasan ng ating bansa.

Howie: Tama ba, you had an idea and plans na about BRA, even before noong controversy with China? Magkakaroon ba--

Sen. Win: Nakita kasi namin na ang BR ay hindi lang energy potential, may food security, biodiversity aspect and even mineral potential. Hindi naman natin pwede mag focus lang sa energy exploitation dahil masisira naman ang ating kalikasan. So the concept of the BRA is a holistic sustainable development, so ibig sabihin kung ano man ang makukuha natin doon, whether food or energy, dapat magagamit ng mga susunod na henerasyon.

Howie: But way before we can exploit those resources we have to protect our sovereign rights, that's why our Defense Secretary sounded alarmed, is this development authority going to be proposing any security measures, are we going to set-up our own patrol, and even get our own intelligence, imbis na umasa sa Amerikano, na nagbibigay satin ng mga satellite photos that information tungkol sa ginagawa doon sa BR?

Sen. Win: Tama, that's why we decided to have 2nd hearing para maimbita yung DND and DFA para mas kumpleto pa ang approach natin sa BR. In the wake of possible incursions, dapat magkaroon din ng representation ang DND dito sa development Authority. Ang mahalaga din dito ay yung makukuha natin ang long-term strategy weather it's defense or in other aspects.

Howie: Sir, I want to ask you also about the Barangay Elections, nagpatawag ng emergency meeting si Senator Pimentel para pagusapan ang possible cancellation ng barangay elections, were you in the meeting and what were discussed?

Sen. Win: Actually nasa meeting rin ako it was more of a brainstorming session. It was very casual and hindi lang naman yun ang aming pinag-usapan. We also talked about other issues in the Senate. Kinuha ni SP ang aming mga opinyon, walang definite conclusion.

Howie: Yung mga Senador na andun, hindi kayo kumpleto no? ka allyado lang ba ng pangulo--

Sen. Win: Hindi kumpleto--

Howie: were most of the people there allies of the President?

Sen. Win: These are part of the majority, yes. Since naka break kami ngayon, marami din sa kasama natin ay nasa ibang lugar. It was an informal brainstorming session sa ating mga kasama.

Howie: doon po sa brainstorming, cancellation of the barangay elections, is it still a viable option for you and your colleagues?

Sen. Win: I remember from the first hearing, during the postponement of the Barangay elections, I think this was late last year, natanong doon sa hearing kung ano yung rason bakit ikakansela ang elections. Secretary Sueno said, ito ay para magkaroon sila ng karagadang oras para mag file ng kaso at tanggaling yung mga kapitan na sangkot sa illegal drugs. I think from my latest information almost 40% of our barangays are contaminated with illegal drugs. So para sakin, itong 40% mahalagang matanggal sa sistema. Dahil itong 40% na ito ay pwedeng nilang gamitin ang nakuha nila sa illegal drugs para sa kanilang campaign activities. Kaya napaka-halaga ngayon from the time na nagkaroon kami ng pagdinig dun sa postponement until now kung ano nangyari doon sa mga kaso at kung mayroon ng mga kapitan na natanggal sa pwesto dahil sa illegal drugs.

Howie: may mga nag babatikos ng mga option na yan, dahil kung totoo yan edi gawing campaign issue, pwede naman gawin campaign ni Duterte na kayo mismo na wag iboto ang mga kandidato na ito dahil mag reputasyon sila, isn't that what should be done in a democracy rather than simply removing somebody from office or cancelling an election?

Sen. Win: Kasama na yun, when you file a case against the barangay captains who are involved in illegal drugs, kakalat na rin yan sa community. More importantly, they will have an opportunity to defend themselves at the same time it will give DILG the right to remove them legally. Ang importante mawala sila sa sistema. If the 40% is proven accurate nakakatakot talaga dahil sila ay nakakalat sa bansa. Kung halos kalahati ng barangay officials ang nakasama sa illegal drugs, then magagamit talaga nila ito sa kanilang pag kampanya.

Howie: This kind of risks opening a pandora's box, kasi kapag ginamit yun na basehan sa pag kansela ng election, what's stopping the President from cancelling other future elections? Maraming Mayor at Governor na sangkot sa droga, he can use that drug list for elections of mayors or city council or governors on the basis of cancelling future elections?

Sen. Win: for me no, we need to understand this issue fully, I think sa ngayon, the DILG and intelligence agency, sila ang may alam kung sino sino ang sangkot no, and if we go back to the barangay issue, alam nila ang 40%. I don't think naman lahat ng kapitan natin ay sangkot sa illegal drugs. For example, in Valenzuela, I can say in a straight face na yung mga kapitan namin ay lumalaban sa illegal drugs, even risking their lives dahil yung iba nakakakuha ng banta sa kanilang mga buhay. The problem here is the 40%, sila ang dapat matanggal sa pwesto para hindi na mabalik at magamit ang nalikom nilang pera sa pagkampanya.
