WIN TRANSCRIPT AMBUSH INTERVIEW ON SOLAR PARA SA BAYAN AND LOWERING THE AGE OF CRIMINAL RESPONSIBILITY

SOLAR PARA SA BAYAN

SEN WIN: Ang objective natin ay mabigyan ng kuryente ang natitirang 2.7 million households na wala pang kuryente hanggang ngayon dahil ilang taon na din silang walang kuryente at dapat lahat ng kababayan natin ay may kuryente. Ngayon, may bagong teknolohiya na ino-offer, ito yung Solar Para sa Bayan na papasok sa mga lugar na walang kuryente at gagamit ng bagong technology. Dahil sa sobrang bago ng technology na ito, wala pang batas, regulation, at policy kung paano gamitin itong bagong technology na ito kaya nandito tayo ngayon para masigurado muna natin ngayon na mayroon tayong batas at regulation bago pumasok itong mga bagong technology dahil ayaw nating mangyari na magulo on the ground kaya kanina doon sa hearing, sinisigurado natin na yung operationalization nitong franchise na ito ay wala dapat gulo sa mga lugar at smooth ang pagbibigay ng kuryente.

Q: Kailangan ba ng franchise? Ang sabi kasi ng iba no need for a franchise?

SEN WIN: Ito yung pinag-aaralan namin ng mabuti dahil itong ino-offer ng Solar Para sa Bayan ay bagong technology ito so kailangang pag-aralan ng mabuti kung kailangan ba ng franchise nitong bagong technology o kung pwede na itong pumasok sa mga existing procedures ng gobyerno, itong mga qualified third-party.

Q: The committee intends to finish this by when?

SEN WIN: Hopefully within the week dahil we are a sub-committee and dineligate sa Committee on Energy ng Committee on Public Services yung technical, economic and legal aspects nitong franchise na ito kasi very technical eh and we cannot discuss it in 15 minutes. We really have to go through the detail para masigurado nga natin na kapag in-operationalize itong franchise, hindi magkakagulo sa communities natin. We've seen a lot of problems--sa Davao, at marami pang mga franchises na nag-aaway dahil hindi clear yung rules pagdating sa operationalization.

Q: So this is the last hearing then TWG na?

SEN WIN: Well, there's one more hearing on Wednesday pero ito ay consolidated na ng Public Services and Committee on Energy. Titingnan nila ang other aspects, I think they will look at the market aspects, we will contribute to the discussion ng Public Services Committee.

Q: May bearing ba yung apprehension tungkol sa pricing ng kuryente na ibibigay?

SEN WIN: Meron, may bearing yan. In fact, yun yung dinidiin namin kanina at gusto naming makakuha ng sagot sa Energy Regulatory Commission kung mayroong effect ito sa outside of the underserved and unserved areas. Yan yung hindi masagot ng klaro ng ERC so they will just give us a position paper by the end of the week. Ang concept kasi dito, kapag binawasan mo ang lugar ng isang kooperatiba, yung nasa labas ng binawasan, tataas yung presyo--that's a basic concept. So sinisigurado natin ngayon na kahit bawasan, hindi tataas ang presyo nung sa labas.

Q: Yung pagseserbisyuhan sa loob, yun yung medyo secure yung pricing?

SEN WIN: Correct, yung nasa loob, yun yung secure ang pricing pero yung sa labas, dahil binawasan mo ang demand niya, tataas ang presyo. Yun yung gusto naming malaman technically, it's a technical question, ERC will run some simulation para masigurado na hindi tataas ang sa labas.

Q: Paano yung provisions ng cross ownership?

SEN WIN: Yung cross ownership, we will make sure that it will be included na kahit na mabibigyan ito ng franchise, it should comply with the cross-ownership limitation dahil lahat ng generator ay nag co-comply eh, generator rin ito so dapat mag-comply siya with cross-ownership provisions. This is going to be the first of its kind, bago talaga ito. Normally, ang franchise ay per location pero ito ay nationwide. Ang target niya ay mga underserved at unserved, ito yung mga lugar na walang kuryente or hindi 24 hours. It's a nationwide franchise, bagong-bago ang concept, the technology is almost new kaya pinag-aaralan nating mabuti kung ano yung apekto nito sa mga consumers natin.

Q: Paano yun Sir, mauuna yung franchise?

SEN WIN: That is actually one of the disappointments na nakuha natin dito dahil normally, may batas ka, mayroon ka nang regulation, may policy ka na sa ganitong mga bagong technology. Kung nag-apply na ang mga applicants, ready ka na dapat kasi hindi naman pwedeng nandyan na ang mga applicants pero wala ka pang regulation. For example, sino ang magre-regulate ng presyo ng kuryente? So dapat very clear yan na ERC pa rin. Paano kung may conflict? Sino ang mag-aayos ng conflict? It has to be DOE so again, the normal process is mauna muna yung law, regulation and policy so everyone kapag nag-apply sila, pantay-pantay ang treatment.

Q: Sir, this is new technology but in accordance with the renewable energy?

SEN WIN: It's a hybrid eh--it's a renewable energy and also a distribution process so ibig sabihin, nagdi-distribute siya ng kuryente na siya rin ang nagpro-produce through solar. Very new technology in a sense.

Q: Hindi po ba makokontrol yung renewable energy sector, kasi siya yung magiging kauna-unahan na bibigyan ng franchise, so I think yun yung magiging apprehension?

SEN WIN: Ngayon, for example, gusto mong magtayo ng solar, pwede yan, hindi mo kailangan ng franchise. Kakailanganin mo ng franchise kapag nag-distribute ka sa mga household so mayroon siyang distribution-in-one so kailangan talaga ng franchise.

Q: So yung grupo ng anak ni senator Loren, kailangan ng franchise dahil magiging distributor sila?

SEN WIN: Kailangan niya ng franchise sa distribution but this is a new technology na mag-isa lang siya, ang tawag dito micro-grid technology kaya dito natin pinag-aaralan kung kailangan talaga ng franchise at anong regulation ang iaapply natin sa new technology na ito.

Q: But definitely Sir, amendments to the law should follow?

SEN WIN: I think there are two options: one, to completely amend the law to make sure na yung regulation at policy are well within the law and well within the franchise; two, gumawa na ng bagong batas para clear at even ang playing field so there are two tracks na pinag-aaralan natin. Kaya nga ang Meralco ay distribution, may franchise siya pero wala siyang generation na solar.

Q: So parang siya ang magiging counterpart ng Meralco?

SEN WIN: Pwede.

Q: So ano ang magiging safeguards?

SEN WIN: That's a good question, yun ang ilalagay naming ngayon na mga safeguards. One, ERC should regulate to make sure na yung presyo na china-charge ay regulated; second, yung competition angle, kanina yung PCC, nagsalita na dapat hindi ma-limit ang competition so mayroon tayong bidding competition ngayon kapag generation so dapat kasama pa rin siya doon.

Q: Ano po ang magiging recommendation niyo?

SEN WIN: Pag-aaralan namin ngayon, sobrang daming nagbigay ng inputs and all the inputs are all valid so we will have to study very carefully and wait for the third hearing dahil pangatlong hearing na ito this coming Wednesday para ma-consolidate na itong report ng dalawang committee. Since this is a very new idea, new proposal, dalawang committee ang naghe-hear, almost three hearings na ang gagawin natin to make sure na covered natin ang lahat ng issues.

Q: Bakit parang smooth sailing ang pagpasa ng franchise bill nila sa Lower House and yet dito, may mga nakitang problem?

SEN WIN: That's a very good question also, hinihingi ko ang transcript pero hindi pa nila binibigay ang transcript para mapag-aralan ko ang discussion pero hanggang ngayon, hindi pa nabibigay.

Q: Do you share the same concern na it might create a monopoly?

SEN WIN: I really have to study whether that statement is correct, kung monopoly talaga siya. Kung ni-limit mo naman siya sa unserved and underserved areas, then hindi siya monopoly nationwide, in effect, pwede siyang mag-serve doon sa mga underserved and unserved areas but we need to also study kung pwedeng pumasok pa yung iba.

Q: Pero sir, ang magiging focus niya lang talaga ay unserved and underserved?

SEN WIN: Should be. Yun ang strictly ilalagay namin sa batas, yun din yung apprehensions ng mga resource persons natin kanina because it's not so clear in the law.

Q: Hindi siya magiging possible option ng mga consumers like in Metro Manila?

SEN WIN: Hindi. Hindi siya makakapasok sa Metro Manila unless kung walang kuryente sa inyo, let's say sa isang barangay, baka pwede. May mga comments din kanina ang mga legal experts because typically, ang franchise, identified ang location eh, pero dito, ia-identify pa lang so that's a legal question that we have to study.

Q: Do you plan to identify the areas eventually Sir?

SEN WIN: Marami eh, there are about 955 areas identified by DOE and pwedeng dumami yan at pwedeng kumonti. It's very difficult to put in the law.

Q: Pero kayo po mismo, mayroon kayong data na 2.7 million households na walang kuryente, so yung data niyo came from DOE?

SEN WIN: Correct, sa DOE yan. It's 2.7 million households na walang kuryente and then there are 955 areas--sitio, purok at barangay na walang kuryente so itong areas na ito, 955 pwedeng pumasok ang Solar Para sa Bayan or ibang proponents na gustong magdala ng kuryente.

LOWERING THE AGE OF CRIMINAL RESPONSIBILITY

SEN WIN: Personally, I'm not in favour of lowering down eh dahil sa Valenzuela, five years ago, nag-implement na kami ng Bahay Pag-asa. In our experience there, 75% ng mga batang pinasok doon ay nabalik namin sa pamilya, nag-aaral, ang iba nasa UP pa. So kung may proper facility, proper intervention program and the LGU will work, may pag-asa ang mga bata. Ang punto ko lang naman, ang Juvenile Justice Act, hindi natin nabigyan ng pag-asa ma-implement. Sa aming computation, sabi kulang tayo ng 58 na Bahay Pag-asa, that only amounts to about 2.6 billion pesos, konti na lang makokompleto na natin ang Bahay Pag-Asa at konti na lang, mabibigyan natin ng pagkakataon at bagong pag-asa ang mga bata at ginawa namin sa Valenzuela so kung nagawa namin sa Valenzuela, I'm sure kaya nating gawin sa ibang localities yun.

Q: So hindi kayo pipirma doon sa Committee report?

SEN WIN: I'm not in favour of lowering down precisely because we've executed the law in Valenzuela at yung experience namin ay maganda. Biruin mo, 75% nabalik natin. 7 out of 10 nag-aaral, nakabalik sa pamilya nila. It's really a matter of implementation, the LGU plays a big role, malaking papel ang ginagampanan nila eh kung ang local government magtatayo sila ng Bahay Pag-asa at lalagyan ng mga tao. In fact, sa Valenzuela nga, nag-tie up kami sa religious groups dahil natuklasan naming ang mga bata naghahanap rin ng deeper change within themselves, the religious group can offer that spiritual intervention so maganda ang experience namin.

Q: Yung Valenzuela daw po is rich di ba, yung mga LGUs daw po na they can't put up Bahay Pag-asa.

SEN WIN: No, the law calls for provinces and highly urbanized cities. Ang Valenzuela is a highly-urbanized city, we're not different from Mandaluyong, Pasig, Muntinlupa. In fact, in Metro Manila out of the 17 LGUs dalawa lang ang Bahay Pag-asa dito. So anong ginagawa noong 15 na kapareho namin sa Valenzuela? highly urbanized din naman kami. It's really pushing the LGUs to put up the bahay Pag-asa, partner na lang with the National Government at maglagay na lang tayo ng 2.6 billion, magpatayo ng Bahay-Pagasa and come up with an effective intervention program.

Q: Are you saying that LGUs just neglected the obligation?

SEN WIN: I think it's both, dahil yung Juvenile Justice Welfare Council (JJWC) trabaho nila na masigurado na meron tayong Bahay Pag-asa nationwide. Bakit ngayon lang nila sinasabi na kulang yung pondo? Itong 2.6 billion, nakita naman natin yung 75 billion madaling napasok sa budget, bakit yung 2.6 billion hindi maipasok para mabigyan natin ng bagong pagkakataon yung mga bata?

Q: Sir so you're saying that the current law is enough there is nothing to change?

SEN WIN: based on our experience on the ground the current law is enough, kumpleto na yung batas na yun hindi lang na execute ng mabuti. Hindi lang napapatayo yung bahay pag-asa at hindi lang nalalagyan ng social workers dahil ang bahay-pagasa kailangan rin matutukuan ng council.

Q: may effort na ba na bago kayo mag adjourn ma-approve na siya?

SEN WIN: maganda ilagay ito sa floor for debates, I think maganda mapakinggan din in the floor for debates, kung papasok man, then let's talk about the effects of the law.

Q: sino ba dapat ang pumupukpok sa LGUs kasi sa government, sa batas, dapat 1% dapat ang i-allot?

SEN WIN: may mechanism na nga eh, hindi ako naniniwala na walang pondo yung mga highly- urbanized cities dahil malaki ang kanilang income and the provinces meron din silang pondo-- I think it's a combination of the JJWC and Department of Interior and Local Government (DILG) dahil and DILG, they should make sure the law is being implemented.

Q: diba may autonomy ang mga LGUs so they can prioritize anything?

SEN WIN: Yeah, that autonomy naman we're not encroaching on that autonomy but this is a national law and national law prevails over all the local laws. In that sense, since may national law tayo na sinasabi na magpatayo ng Bahay Pag-asa sa probinsya and sa highly urbanized city, dapat iniimplement na yan ng local governments but then again meron ka nang local council, yung council na yun ang trabaho niya ay siguraduhin na may Bahay Pag-asa at siguraduhin na may programa dahil hindi lang sapat na magpatayo ng pasilidad dapat ang programa doon ay effective din para yung bata hindi na pabalik-balik para pag labas nila reformed na sila.

Q: Willing ba ang Valenzuela mag share ng best practices nila?

SEN WIN: Yes, I think ganun naman ang mga LGU's they share their best practices. Kung makakatulong ang Val sa ibang LGUs, open tayo, pero ang importante ngayon ay mabigyan ng bagong pag-asa yung mga bata dahil in this case pag binabaan natin [age], nakita ko na tong nangyari, kapag deretso na sa kulungan mahirap na mareporma yung mga bata.

Q: do you oppose the bill?

SEN WIN: I'm not in favor of lowering it down--

Q: so, if you are not in favor you, you are going to oppose this?

SEN WIN: if that goes to the floor then yes.

Q: what if ilagay yung mga improvements in the implementation? But they will still lower it?

SEN WIN: I will have to study that, yung mga improvements na yun. My fear kasi is yung mga bata baka masama na sa ordinary criminals, ordinary jails yun ang fear natin.

Q: what if assurance sayo na separated [yung mga bata] from the usual?

SEN WIN: we have to study yung mga proposals but at it stands right now I'm not in favor of lowering it down. I think the current law ngayon is sapat na, hindi lang naiimplement ng maayos.

Q: reformation and rehabilitation?

SEN WIN: yung batas ngayon may reformation and intervention na eh so why change it? Ang next question diyan saan mo irereform?

Q: pano yung mga below 15, kaya daw ibaba para yung mga below 15 maipasok na rin sa rehabilitation?

SEN WIN: again, we have to study the proposals. Madaming proposals na lumalabas but ang basic concept ay yung bata ay maipasok sa Bahay Pag-asa, mareporma siya, at siguraduhing maayos yung intervention program para mabalik sila sa family nila. Itong mga batang to may pag-asa pa at hindi mawawalan ng pag-asa kung tama yung intervention program, may pag-asa pa silang magbago.

Q: Kelan sir nag start yung Bahay Pag-asa sainyo sir?

SEN WIN: term ko, may tatlo kami, we have yung Bahay Pag-asa, Bahay Kalinga [para sa street children] and yung Bahay Kanlungan para sa mga matatanda.

Q: pero maraming bata talaga?

SEN WIN: marami, ngayon ang population ng Bahay-Pagasa namin is about 60. Ang iba dun napansin naming gusto nila doon dahil pag umuuwi sila sa bahay nila magulo. So they're not there because they did something illegal but some would go there to simply seek refuge. Yung iba ayaw pa nila bumalik [sa dating masamang gawi] dahil doon meron kaming education, training--

Q: may age limit po ba yung bahay pag-asa ninyo?

SEN WIN: until 18, until mag college, kaya ang kailangan doon sinasabayan ng alternative learning system or meron dapat from DepEd na pumupunta doon. Pero normally alternative learning system. It's financed by the LGU, it's not so big ah, the budget is not so big. Dati it was about 15 million for the building and another 15 million for operations and maintenance a year more or less. Complete with staff, with social workers, importante doon yung social worker dahil iba po talaga kapag social worker ang nakatutok sa mga bata because they know how to communicate to them, may psychologists din pero yun part-time lang pumupunta.

Q: so yung operational expenses 15 million per year?

SEN WIN: yes, more or less per year. Ngayon medyo tumaas na dahil mas rumami na but during that time when we started more or less ganun yun. Full-time workers namin doon mga 10 kasi 24 hours yun eh, it's a 24-hour operation. Meron ka sa umaga meron ka a gabi, nakahiwalay yung boys and girls.

Q: Sir ano yung isa pang city?

SEN WIN: hindi ko maalala pero yung sinabi sakin nung nag survey kami na dalawa lang yung LGU- run na Bahay Pag-asa. Ang alam ko Quezon City ay nagpapatayo na sila ngayon. Pag mga street children iba pa yun, sa Valenzuela tawag naming dun Bahay Kalinga kaya mapapansin niyo sa Valenzuela walang nagmamalimos.

Q: parents nila sir?

SEN WIN: Seminar, pinag seseminar namin yung mga parents.

Q: pwede puntuhan yung Bahay Pag-asa?

SEN WIN: Yes, yes some went there already to do a documentary dahil hot topic.
